CHECK-IN & CHECK-OUT
All guests must present a valid personal ID or passport when checking-in.

Villas are made available to Guests as from 2:00pm. Guests who wish to have access to their villas before 2:00pm must book the villa from the day before.

Guests who arrive earlier than the check-in time may store their luggage in a storeroom until their villa is ready.

Guests are required to present a valid credit/debit card upon check-in along with a valid form of identification.

DRIVER’S ACCOMMODATION
Waterland does not have driver’s accommodation. We can arrange driver’s accommodation for a 20 USD per night charge. This charge includes the driver’s breakfast.

REFUSAL OF SERVICE
Waterland reserves all rights to refuse service to any guests who do not follow or comply with hotel policies, who are disruptive, whose behavior is deemed inappropriate, or who do not treat others with the respect that they deserve.

TRAVELING WITH MINORS
Guests must be 18 years or older to check in without a parent or legal guardian.

No children under 8 are permitted.


SMOKING
No smoking is allowed indoors including in the villas and the lounge.

PETS
Guests may not bring pets to the property.

NO PARTY POLICY
To ensure we can protect the hotel and our guests at all times, no parties are allowed either in the villas, the decks, or the public areas. Guests who do not follow this policy will be given a warning. If they do not immediately follow this warming and cease the disruptive activities, the guests must leave the property immediately.

RESPONSIBILITIES OF THE HOTEL
The Hotel shall be liable for damage resulting from its wilful intent or gross negligence, or that of its representatives and agents, or resulting from its failure to comply with its material obligations under this agreement. The Hotel shall also be liable in case of death or physical injury of the Guest, as a result of acts or negligence of the Hotel.

The Hotel shall not be liable for any deterioration, destruction or theft of the those objects that can be imputed to the Guests or people accompanying, visiting or serving him, that result from armed robbery or that result from the nature or defects of the object.

The Hotel's responsibility for all other cases than those exhaustively indicated above, shall be limited to the price paid by the Guest for his reservation.

The Hotel does not accept any liability for destruction or theft of vehicles parked on the Hotel's premises, for services rendered by third parties to Guests, even if those services were organized by the Hotel, for damage, losses, expenses and any other sums which did not result from any breach of contract or other fault by the Hotel or, where the Hotel is responsible for them, of its employees, agents or suppliers.

In any event, the Guest must immediately notify the Hotel of any discovered damage, in order for his claim to be admissible.

GUEST RESPONSIBILITIES
The property shall be in substantially the same condition as it was at the time of the initial occupancy. The Guest shall be liable for damage caused by his act, omission or negligence. If the damage is discovered after the Guest has left, the Hotel reserves the right to charge the Guest's credit card with; or to send an invoice for, the amount required to repair any such damage.

FORCE MAJEURE
The Hotel is not liable and shall not owe any compensation or damages if it is unable to fulfil its contractual obligations due to force majeure, or if the Guest suffers damage as a result of a force majeure event. For the purposes of this clause, "force majeure" shall mean all facts and circumstances which the Hotel could not reasonably foresee or prevent, such as, for example, natural or nuclear disaster, war or the threat of war, terrorist activities or the threat thereof, strikes, floods, fires, etc.

Dispute Resolution/Problems
The Parties will attempt in good faith to resolve any dispute or claim arising out of or in relation to this Agreement through negotiations between a representative of each of the Parties with authority to settle the relevant dispute. If the dispute cannot be settled amicably within fourteen (30) days from the date on which either Party has served written notice on the other of the dispute then the remaining provisions of this Clause shall apply.

APPLICABLE LAW AND JURISDICTION
The law of the jurisdiction in which the Hotel is located shall be the governing law.
The Hotel and Guest submit to the exclusive jurisdiction of the courts of Negombo, Sri Lanka to settle any dispute which may arise out of or in connection with these general conditions.

3RD PARTY
This Agreement may not be assigned or transferred to a third party by either party without the written consent of the other party.

WAIVER
The waiver by either party of a breach by the other of any provision of this Agreement shall in no way be construed as a waiver of any succeeding breach of such provision or a waiver of the provision itself. No waiver of any provision of this Agreement, whether by conduct or otherwise, in any one or more instance, shall constitute a waiver of any other provision, nor shall such waiver constitute a continuing waiver, and no waiver shall be binding unless executed in writing.

SEVERANCE
If any unlawful and/or unenforceable Clause would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the Clause will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant Clause will be deemed to be deleted).
